Can a quadriplegic walk a block without the aid of artificial legs or crutches? It is just as impossible for a law abiding citizen to pay his debts when government withholds assets belonging to another without just cause.
"There are cases when an individual has been wrongfully treated by his government andabout the only way, unless the individual resorts to court, and even in some cases the courtsare not able to give proper relief, the only area or avenue open to the individual is throughhis representative. When you find a bona fide error has been made, I suggest that you makea maximum effort to remedy it. This I feel is a vital and important function of those of us inthe House of Representatives."
Authors: Donald G. Tacheron and Morris K. Udall, from the book entitled "The Job of the Congressman", pages 65 and 66. (This important duty applies to all elected officials, all government employees, and all U.S. citizens)
Article 1, Section 7, of the California Constitution states: " A person may not be deprived of life, liberty, or property without due process of law or denied equal protection of the laws...." and Article 1, Section 26 states: " The provisions of the constitution are mandatory and prohibitory, unless by express words they are declared to be otherwise".
"Government is instituted for the common good; for the protection, safety, prosperity, and happiness of the people; and not for profit, honor, or private interest of any one man, family, or class of men; therefore, the people alone have an incontestable, unalienable, and indefeasible right to institute government; and to reform, alter, or totally change the same, when their protection, safety, prosperity, and happiness require it." by John Adams, Thoughts on Government, 1776
……..meaning it is crystal clear to anyone who comprehends the written as to the primary function of any elected official and the role of government to its’ law abiding citizens.
Elected Black leaders affiliated with the Democratic Party, such as President Barack Obama, 2nd District Supervisor Mark Ridley Thomas, 10th City Council Herb Wesson, Congresswoman Diane Watson, Congresswoman Maxine Waters, etc., etc., all being black elected officials affiliated with the Democratic Party, still don’t get it, meaning these individuals are disgraceful, inept, and have more than just a few screws loose in the old noggin.
Amendment XIII. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.
Amendment XIV, Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
In spite of the falsehoods and lies that lack factual basis sent my direction by LADWP management personnel, or Deputy City Attorney Lisa Berger, I’m a thirty year Los Angeles City employee with a clean record and stellar reputation, whose retirement and other benefits are being held without good cause. The LADWP continues to hold my retirement benefits and other benefits without just cause.
I met with attorney Gary Casselman, a prominent successful “Civil attorney” in the Los Angeles area, for his expertise in acquiring a substantial sum of earned insurance benefits from a 30 year paid up life insurance policy, and this too, has not materialized.
I hired attorney Ricky Ivie, a prominent Black attorney in the Los Angeles, who did absolutely nothing for the legal fees received. Attorney Ricky Ivie has to be reported to the authorities, the result being virtually all legal fees were returned.
In most criminal proceedings, court decisions and swift penalties targeting Black men who are in violation of the law are signed by the judge of court of record .
In other instances, to where the government has egregiously violated the law to take property, jail, fine, destroy the reputation, violate the lawful right to gainful employment, hold retirement benefits, etc ., of law abiding U.S. citizens such as Leon E. Lofton, Jr., Mrs. Esther M. Lofton, Michael Lofton, the Lofton Family, Carl Steadman, etc., as documented by Los Angeles Superior Court Cases BC 385899, C895188, BS121571, which is proven egregious failure or stalling to disrespect the rule of law, the U.S. Constitution, the California Constitution, all with the blessing of Black America’s brain dead no good Democratic Party affiliated elected black leaders. The Democratic Party the so-called vanguard for the oppressed, etc., etc., meaning the Democratic Party specifically through this misfit group of elected Black leaders and/or others, are not about fairness and equity, but rather, the Democratic Party is indeed strongly “Jim Crow and Black Code law enforcement” oriented.
As reality would have it, as it concerns the courts, civil litigation, any petition for redress for the wrongs of a government seriously gone awry, the only individuals who have competently served my best interests have been my Dad, Mom, and I.
I’m a law abiding black man. I play by the rules and abide by the law to uphold the rule of law to protect my property rights, lawful rights, reputation, etc. This cannot be said or proven for Black elected officials paid with taxpayer’s dollars, sworn under oath and mandated by law to uphold the Constitutional rights of all U.S. citizens, law abiding U.S. born Black men, women, and/or his or her siblings being inclusive. “Brain Dead” elected Black leaders again is truly appropriate.
On Thursday, July 22, 2010, the LADWP utility workers cut power from the utility pole on my property to my home for failure to pay utility bills, yet the LADWP continues to hold my retirement and other benefits. Prior to removing power, my Mom, Mrs. Esther M. Lofton, stated this is a civil matter supported by Los Angeles Superior Courts Cases BC 385899, C895188, BS121571. My Mom, Mrs. Esther M. Lofton, also stated although I am licensed to use a gun and have the right to exercise the 2nd amendment to keep the LADWP and/or others from entering our property, I know that you (LADWP representatives) want to return home safely to your families, and I want to avoid this type of deadly possible life endangering armed confrontation too.
During the interim, namely this three week period, we used a generator to maintain power to our residence. It is much more expensive to provide gasoline for a generator supplying power to your home, which only adds more difficult when the LADWP and/or others, hold assets due you, with legal authority and just cause. Again, Los Angeles County 2nd District Supervisor Mark Ridley Thomas was contacted, but to no avail. The jest of it, “We cannot help you, call the county counsel's office”. On Thursday, August 12, I, Michael Lofton, climbed the utility pole on our property to reconnect power to our residence.
My Mom, Mrs. Esther M. Lofton, is exercising her 2nd amendment right to bear arms to keep the authorities, The Department of Building and Safety, the LADWP, etc., off of our property. Should the police, namely the LAPD, the LA County Sheriff’s Department, etc., respond through the use of deadly force, my Mom made arrangement for me to stay at another location. Since there is little if any civil law enforcement for Black men, the consequences of a black man exercising his 2nd amendment right, even when he is on the right side of the law, can be very deadly.
In the event the LAPD responds through the use of deadly force, under conditions that mandate civil law enforcement and not penal law enforcement, in the interest of remaining in the “land of the living”, through the kindness of my Mom's VFW friends, I have safe refuge for a couple of days, these VFW individuals being law abiding, outstanding, and honorable Americans.
It is hoped that this message is shared with the LAPD and/or others so that more emphasis is placed with civil law enforcement and not penal law enforcement so that my Mom remains in the land of the living, and the principles to which this nation stands, namely the U.S. Constitution and California are equally and adequately enforced, so that the lawful rights of Leon E. Lofton, an honorably discharged disabled WWII veteran, Jr., his widow, Mrs. Esther M. Lofton, his son Michael Lofton, other the Lofton Family members, Carl Steadman, and/or others, egregiously violated by the atrocities of a government seriously gone awry, as documented by Los Angeles Superior Court Cases BC 385899, C895188, BS121571 are respected.
