Hello America.
I Michael Lofton, am the son of Leon E. Lofton, Jr., an honorably discharged disabled draftee combat Veteran of WWII. My Mom, Mrs. Esther Lofton, is the widow of Leon E. Lofton, Jr., My Dad, Mom, and I, are U.S. citizens by birthright.
I come to you today, as a 30 year Los Angeles City employee with a clean work record, whose retirement and other benefits are being held without cause by the LADWP.
As of Thursday, July 22, 2010, I have been without LADWP provided electricity because the LADWP disconnected electric service from the pole to my home, for failure to pay the LADWP utility bill. Prior to being disconnected from LADWP utility power, I’ve been denied retirement income from the LADWP without good cause, the only means that I have to pay utility and/or other bills. Like many other members of the working class, I don't have access to a money tree in my backyard, or any wealthy heirs that I can call upon for any source of income.
To keep my food from spoiling I'm using a Homelite 3500 gasoline powered generator to supply electricity to my refrigerator and other necessities. In the interim at least one or more of my neighbors have contacted the LAPD. LAPD Officers have come to my residence to ask that I shut off the generator down during night and early morning hours. To keep refrigerated food from spoiling, I must keep this generator running continuously.
I'm an over thirty year law abiding taxpaying resident of the 10th Los Angeles City and 2nd Los Angeles County Districts. This is not a police law enforcement issue. This is a civil matter that requires competent elected official representation and/or “Equal Justice and Protection Under the Law” as it pertains to the Superior Court for the County of Los Angeles, to respect my property rights, so that I won't have to use a noisy generator to disturb my neighbors to supply electricity to my home.
"Government is instituted for the common good; for the protection, safety, prosperity, and happiness of the people; and not for profit, honor, or private interest of any one man, family, or class of men; therefore, the people alone have an incontestable, unalienable, and indefeasible right to institute government; and to reform, alter, or totally change the same, when their protection, safety, prosperity, and happiness require it." by John Adams, Thoughts on Government, 1776
Article 1, Section 7, of the California Constitution states: " A person may not be deprived of life, liberty, or property without due process of law or denied equal protection of the laws...." and Article 1, Section 26 states: " The provisions of the constitution are mandatory and prohibitory, unless by express words they are declared to be otherwise".
"There are cases when an individual has been wrongfully treated by his government andabout the only way, unless the individual resorts to court, and even in some cases thecourts are not able to give proper relief, the only area or avenue open to the individual isthrough his representative. When you find a bona fide error has been made, I suggest thatyou make a maximum effort to remedy it. This I feel is a vital and important function ofthose of us in the House of Representatives."
Authors: Donald G. Tacheron and Morris K. Udall, from the book entitled "The Job of the Congressman", pages 65 and 66. (This important duty applies to all elected officials, all government employees, and all U.S. citizens)
In light of the U.S. Constitution and California Constitutions, a U.S. citizen shall not be denied property rights without good cause. My retirement benefits are property that I have earned through years of service and age.
My Mom, Mrs. Esther M. Lofton, called 2nd District Supervisor Mark Ridley Thomas’s office on Friday, July 23, 2010, regarding the foregoing, and the only response thus far is “We cannot help you, call the county counsel's office” as stated by Renita (Renata, Renuta) one of Supervisor Mark Ridley Thomas’s staff employees.
Contrary to this response to date, former President of the Los Angeles City Civil Service Commission Sylvia Drew Ivie whose job classification is Administrative Assistant for Supervisor Mark Ridley Thomas, 2nd District Supervisor Mark Ridley Thomas, nor has any member of Supervisor Thomas’s office done anything to resolve this issue or any other issue presented as it concerns Mrs. Esther M. Lofton, Michael Lofton, Carl Steadman, Theft by Court (Theft by Court), Los Angeles Superior Court Case BS121 571, Judge James C. Chalfant, (213) 974-5889, Dept. 85, Los Angeles Superior Court Case BC 385899, Judge Mark Mooney, (213) 974-5707, Dept. 68, Los Angeles Superior Court Case C 895188,
Stanley Mosk Courthouse, 111 N. Hill Street, Los Angeles, CA 90012.
Furthermore, the Los Angeles County Counsel works for and is paid by the Los Angeles County Board of Supervisors, one being 2nd District Supervisor Mark Ridley Thomas. In contrast, President Barack Obama, the Los Angeles County Board of Supervisors, specifically 2nd District Supervisor Mark Ridley Thomas, Mayor Antonio Villaraigosa, 10th District City Councilman Herb Wesson, are the elected representatives who are paid by and employed by property taxpaying and taxpaying residents and citizens of the U.S., the State of California, the City of Los Angeles, the 2nd Los Angeles County District, such as Michael L. Lofton, and Mrs. Esther M. Lofton, etc., etc. etc.
Mayor Antonio Villaraigosa (Contact Information),10th District Los Angeles City Councilman Herb Wesson (213-473-7010), 2nd District Los Angeles Supervisor Mark Ridley Thomas (213-974-2222) are the elected official or officials of the jurisdiction where I reside.
I need your support to make the laws work for all law abiding U.S. citizens.
Thanks for listening.
Sincerely,
